Michael Cook has more than 38 years’ experience representing health clients of all kinds in regulatory, reimbursement, fraud and abuse,
compliance, business, strategic planning,and public policy matters, with a strong emphasis on post-acute providers. At the beginning of his career, Michael also was an attorney with the Office of General
Counsel at the United States Department of Health and Human Services where he represented the federal regulators of the Medicare and Medicaid programs on matters of the highestlegal and political senstivity.
He recently received the honor of Fellow from the American Health Lawyers Association.

factors that prosecutors should consider when conducting an investigation of a corporate entity in order to determine whether to bring criminal charges.
These factors, commonly known as the “Filip Factors,” include “the existence and effectiveness of the corporation’s preexisting compliance program” and
the corporation’s remedial efforts “to implement an effective corporate compliance program or to improve an existing one.” Notably, the Department of
Health and Human Services, Office of Inspector General (OIG), followed-up in March 2017 with a list of questions that health care providers can use to
evaluate the effectiveness of their organization's compliance program. During this session, attorneys Richard Pecore and Leonard Schneider will examine

Program Description: The RAP will not provide any payment to agencies beginning January 1, 2021, but agencies
may be paying CMS if late. The requirements are not the same, but certain elements leave agency leaders scratching their heads. Lisa and Petria present
the new requirements and how agencies can operationalize the new RAP in a timely manner and still reconcile their accounts receivables.
Face to Face encounter documentation has been the biggest hurdle in PCR, especially with the diagnosis related to the encounter aspect.
Lisa and Petria provide pointers for processing the PCR that will assist in better documentation, and therefore a higher affirmation rate.
