The federal government has also issued new guidance regarding independent contractors. If you use the companionship exemption, you need to know the Department of Labor seems to have succeeded in basically eliminating it for home health care agencies. The need to provide leaves of absence seems to have expanded to the point that employees may not ever have to come to work.
