Program Description: Despite your best efforts to screen and train members of your staff, care issues and complaints will eventually arise. What steps can you take to prevent incidents of abuse, neglect of exploitation from happening in the first place? If allegations such as these arise, what are your obligations to investigate and report these complaints? How can you better prevent allegations of neglect associated with:

  • The prevention, identification and treatment of bedsores.
  • The safe lifting and transfer of a patient from a bed to a wheelchair in a safe fashion without falls.
  • The proper administration of medication.
  • The communication of patient concerns you have identified to family members.
  • Caring for patients with dementia, Alzheimer’s or another mental condition that can be challenging.
  • Communicating with the patient physician when there is a change in a patient’s condition.

Program Learning Outcome: Participants will actively participate in the learning activity and indicate an intent to change their practice by identifying best practices in the areas of prevention, investigation, and reporting of abuse, neglect and exploitation of patients in compliance with state laws and Medicare Conditions of Participation.

About the Presenter:
Richard Pecore
is a licensed Texas attorney with over 20 years of experience in personal injury and health care law. Mr. Pecore is a graduate of the University of Texas and South Texas College of Law Houston. Mr. Pecore joined Liles Parker as an associate attorney in January 2012 and became a partner with the firm in February 2016. Mr. Pecore’s practice focuses on Medicare and Medicaid administrative provider appeals and regulatory compliance plans for providers. He has successfully defended overpayment appeals ranging in value from $15,000 to over $6 million dollars. Mr. Pecore is a Certified Medical Compliance Officer (CMCO), a member of the American Health Lawyers Association (AHLA) and a member of the American Dental Coders Association (ADCA).

About the Presenter:
Heidi Kocher
is a partner with Liles Parker and has over 20 years of experience in health care legal and compliance related issues, including serving as a compliance director, chief privacy officer and interim chief compliance officer at a medical device manufacturer. In addition, she has represented and advised physician groups, home health agencies, DME companies, pharmacies, non-profit organizations, and licensed individuals. Her experience includes implementing the various requirements and aspects of a Corporate Integrity Agreement, responding to and defending audits from Medicare, Medicaid and private insurers up through the ALJ level, guiding clients through voluntary self-disclosures and seeking advisory opinions from the OIG. She also has significant reimbursement experience, addressing coverage policy issues, challenging denials, recoupments, and loss of billing privileges, obtaining HCPCS codes, and other reimbursement related issues.
