Program Description: The move to value-based payments has been increasing since the enactment of the ACA in 2010. These developments turned the enforcement of the AKB and Stark on its head, often requiring individual waivers in these programs, and failing to accommodate programs that the public programs would encourage. To account for these changes and the dramatic movement away from volume and towards value and alternative payment mechanisms, in December 2020, CMS and OIG published a new set of safe harbors to the AKB and exceptions to Stark. These changes are highly technical in nature, but absolutely critical for home health agencies and hospices to understand if the wish to play in this venue – especially with the upcoming implementation of the Medicare VBP demonstration project nationwide and expansion of VBPs and alternative payment systems by other payors. Join Michael Cook and Heidi Kocher as they describe the new safe harbors and exceptions and demystify them so that the attendees will understand both the need and how to comply with them and participate safely in these programs.

    About the Presenter(s):
    Michael Cook
    has more than 38 years’ experience representing health clients of all kinds in regulatory, reimbursement, fraud and abuse, compliance, business, strategic planning,and public policy matters, with a strong emphasis on post-acute providers. At the beginning of his career, Michael also was an attorney with the Office of General Counsel at the United States Department of Health and Human Services where he represented the federal regulators of the Medicare and Medicaid programs on matters of the highestlegal and political senstivity. He recently received the honor of Fellow from the American Health Lawyers Association.

    In addition to his health care practice, Michael serves as a strategic health care advisor to a start-up company that has developed a health care related product to protect seniors from fractured hips. He was appointed by Governor McAuliffe to serve on the Board of the Department of Medical Assistance Services that advises Virginia’s Medicaid program, has served as a health care advisor to a number of candidates for state and national office, and recently received the Albert Nelson Lifetime Achievement Award fromMarquis Who’s Who. He frequently lectures on topics of interest to health care providers and earlier this year presented on the topics of “Internal Investigations” for health care companies at the 2019 American Health Lawyers Association conference on Medicare and Medicaid Payment Issues and moderated a panel of State Medicaid Directors on the changing face of their Medicaid programs in post-acute care for the AHLA Long-Term Care and the Law conference.

    Heidi Kocher
    is a partner with Liles Parker and has over 20 years of experience in health care legal and compliance-related issues, including serving as a chief privacy officer and interim chief compliance officer at a medical device manufacturer. She is currently serving as an outside compliance expert to a hospital and a clinical laboratory that are under Corporate Integrity Agreements. She has significant reimbursement experience, responding to and defending audits from Medicare, addressing coverage policy issues, challenging denials, recoupments, and loss of billing privileges, obtaining HCPCS codes, and other reimbursement related issues. Her experience also includes implementing Corporate Integrity Agreements, guiding clients through voluntary self-disclosures and seeking advisory opinions from the OIG. Ms. Kocher is licensed in Texas and Maryland.
