Program Description:The failure to timely report A&E to the Department of Family and Protective Services a nd to DADS remain one of the higher range license violations among home and community care service agencies in Texas. There are several reasons for this. First, many times management staff have the misunderstanding that they must make a judgment call as to whether or not an allegation has been made. Second, middle management staff and delivery staff usually fail to understand how to dignify an allegation estimate.

This presentation examines final orders from the Texas Health and Human Services commission dealing with allegations of abuse, neglect and exploitation. By examining these cases, as opposed to discussing a hypothetical story, the viewer will gain a better understanding of what goes wrong when an allegation of abuse, neglect and exploitation is not timely reported to the authorities.

About the Presenter:
Troy Brooks
a former Assistant General Counsel for the Texas Department of Human Services, the predecessor agency of the Texas Health and Human Services Commission has practiced almost exclusively in the area of non-acute long term care in Texas and throughout the country. This year marks Mr. Brooks 20th year of practicing law. He began as a judicial clerk for the Honorable B. Dexter Ryland, Chief Judge of Louisiana’s 9th Judicial District Court. Mr. Brooks now has his own firm, The Brooks Law Group, which provides a full range of services for healthcare providers throughout Texas and the rest of the country. In the words of Mr. Brooks, “we don’t have the sense to tell a healthcare provider we won’t help them with something. From corporate law, mergers and acquisitions, ADRs, RACS, ZPICs, UPICs and licensure issues, we do it all.”
