There are several reasons for this. First, many times management staff have the misunderstanding that they must make a judgment call as to whether or not an allegation has been made. Second, middle management staff and delivery staff usually fail to understand how to dignify an allegation estimate. This presentation examines final orders from the Texas Health and Human Services commission dealing with allegations of abuse, neglect and exploitation. By examining these cases, as opposed to discussing a hypothetical story, the viewer will gain a better understanding of what goes wrong when an allegation of abuse, neglect and exploitation is not timely reported to the authorities. Troy Brooks a former Assistant General Counsel for the Texas Department of Human Services, the predecessor agency of the Texas Health and Human Services Commission has practiced almost exclusively in the area of non-acute long term care in Texas and throughout the country. This year marks Mr. Brooks 20th year of practicing law. He began as a judicial clerk for the Honorable B. Dexter Ryland, Chief Judge of Louisiana’s 9th Judicial District Court.
