[3822] Prepare for 2024 with a Financial & Operational Perspective of the Hospice Final Rule
This program is a MUST for all Hospice staff. Presentation Info: TAHC&H Event Administrator Conference | Rich-Media Presentation Capture | Online On-Demand Access Presentation Date | November 8, 2023 Program Description: It is crucial for hospice agencies to understand how the Hospice Final Rules impact agency operations both financially and operationally. The Hospice Final Wage Index & Payment Rule is packed full of changes for 2023-2024 including a projection of 3.1% increase in total hospice payments. However, it is not an overall increase in reimbursement rates for everyone due to the significant and widely varying changes in the wage index that drives the local rates an agency receives from Medicare. This program also includes strategic insights with a comprehensive breakdown of the updates to Hospice Conditions of Participation and Hospice Quality Reporting Requirements. See SimiTree’s national speakers, Mike Simione and Laurie Newlun, as they delve into the conversations that matter. You will gain the knowledge and resources for preparing your agency for the impact of both the value piece and financial piece as well as outline anticipated actions providers should take now. Revised Safe Harbors & Exceptions to Stark for VB Payments & Alternative Payment Methodologies

[W3645] The Revised Safe Harbors for the Anti-Kickback Statute (AKS) and Exceptions to Stark for Value-Based Payments and Alternative Payment Methodologiess
A 2022 TAHC&H Member Webinar - Now Available to All! Presentation Info: TAHC&H Virtual Event | 2022 Monthly Member Webinars | Recorded for On-Demand Access Presentation Date | June 22, 2022 Program Description: The move to value-based payments has been increasing since the enactment of the ACA in 2010. These developments turned the enforcement of the AKB and Stark on its head, often requiring individual waivers in these programs, and failing to accommodate programs that the public programs would encourage. To account for these changes and the dramatic movement away from volume and towards value and alternative payment mechanisms, in December 2020, CMS and OIG published a new set of safe harbors to the AKB and exceptions to Stark. These changes are highly technical in nature, but absolutely critical for home health agencies and hospices to understand if the wish to play in this venue – especially with the upcoming implementation of the Medicare VBP demonstration project nationwide and expansion of VBPs and alternative payment systems by other payors. Join Michael Cook and Heidi Kocher as they describe the new safe harbors and exceptions and demystify them so that the attendees will understand both the need and how to comply with them and participate safely in these programs. HCSSA Topic(s) Addressed: §558.259[d][4]agency responsibilities §558.260[a][3]basic principles of management in a licensed health-related setting §558.260[a][6]risk assessment and management Program Description: At the outset, it is important to keep in mind that there are significant differences between the OIG Exclusion List and the CMS Preclusion List.  The presenters will discuss your obligations, as a Medicare home health or hospice provider, to ensure that your employees, agents, contractors, and vendors have not been excluded from participation in Federal health care programs.  They will also discuss the impact of the CMS Preclusion List on your employment and contracting practices. Both OIG and CMS contractors are actively on the lookout for violations. In this webinar, attorneys Paul Weidenfeld and Robert W. Liles will discuss the importance of exclusion screening, how to screen and which exact databases must be screened – according to both Federal and state regulations, how often and which employees providers must screen, and how providers must document their exclusion screening efforts in order to comply with the law. We will also go over the purpose and nature of the CMS Preclusion List. TAHC&H Faculty/Presenter(s): Paul Weidenfeld and Robert W. Liles | Liles Parker Attorneys & Counselors at Law About the Presenter(s):
Paul Weidenfeld brings a unique perspective to False Claims Act cases, Fraud Investigations and Qui Tam, or whistleblower, lawsuits which is partly the result of his rare combination of having BOTH extensive litigation experience (more than 50 trials and 25 appellate) AND subject matter expertise (10 years as a fraud prosecutor, 2 years as the DOJ Healthcare Fraud Coordinator, and experience as a partner in a major healthcare law firm). Virtually every litigation decision in these complex cases requires an understanding of the persons and agencies involved, an understanding of the law, and an ability to predict how the litigation will actually evolve in the legal system — and there is no one better suited to help in this process. Finally, Paul’s experiences have taught him that there is no one-size-fits-all in the world of settlement or conflict resolution, and he is well known for his ability to find innovative solutions to difficult litigation problems. About the Presenter(s):
Robert W. Liles' background is somewhat unique. In addition to a law degree, he holds a Master’s in Health Care Administration. Robert has worked on the provider side, as a federal prosecutor and now represents home health and hospice agencies around the country in connection with Medicare and Medicaid audits and investigations. While working as a federal prosecutor, he was asked to serve as the first National Health Care Fraud Coordinator for the DOJ’s, Executive Office for U.S. Attorneys. In this capacity, he advised prosecutors around the country regarding health care fraud statutes, schemes, investigative tools, privacy concerns, and compliance issues. Robert is a nationally-recognized speaker and educator on health law regulatory issues. He has taught and lectured at regional and national conferences, seminars and webinars to federal and state prosecutors, auditors, industry representatives, providers and suppliers on a variety of regulatory issues. Setting and Holding Professional Boundaries in Private Home Care

[3666] Setting and Holding Professional Boundaries in Private Home Care
Reviews what's okay and what's not okay when it comes to staff's relationships with clients, and how to mitigate the potential risks to the agency. Presentation Info: TAHC&H Event | Spring Virtual Conference | Recorded for On-Demand Access Presentation Date | May 12, 2022 Program Description: When we talk about boundaries in private duty home care, we sometimes cringe. We cringe because we know that even our best staff cross professional boundaries with their clients, and some obliterate boundaries altogether. This happens despite an agency's best efforts to put professional boundary measures in place and communicate about them constantly. When added to the stressors of daily operations, this frustrating topic gets placed at the bottom of the priority list. "It's going to happen anyway, and our efforts backfire, so what can we do about it?" This session reviews what's okay and what's not okay when it comes to staff's relationships with clients, and how to mitigate the potential risks to the agency.
