Program Description: Regulations are tightening in the hospice industry
both as a constraint against fraud and as a focus on improved quality of care. As new relationships link hospices together with
entities such as nursing homes, assisted living facilities and accountable care organizations, the compliance focus and
governance of hospices must also adapt. In this program Marie discusses significant hospice fraud cases in the last year
while also presenting Congressional actions and OIG Work Plan initiatives addressing fraud, reimbursement changes,
and reporting practices as they affect fraud enforcement.
Program Objectives: Upon completion of this program, the viewer will be able to:

About the Presenter: Marie Berliner, JD, Senior Counsel at Joy & Young, LLP has been counseling healthcare providers,
including home health agencies, hospices, physicians and hospitals, in all aspects of administrative and regulatory compliance, since 1988.
Her practice focuses on Medicare reimbursement, fraud and abuse, physician self-referrals (“Stark law”), licensure and certification,
and other administrative and regulatory healthcare matters. She has also been a regular speaker (2004-2013) on Medicare issues to TAHC&H, The Texas and New Mexico Hospice
Organization, and the University of Texas’ Annual Health Law Conference, and has presented numerous administrator training seminars to home
health and hospice providers on select federal and state laws.
Ms. Berliner is licensed to practice in Texas as well as Maryland, and the
District of Columbia.

referral sources. While collaboration may address some difficult problems, the statute and rules regarding

About the Presenter:
William Dombi, JD is the President of the
National Association for Home Care & Hospice. Bill specializes in legal, legislative, and regulatory advocacy on behalf of
patients and providers of home health and hospice care. With nearly 40 years of experience in health care law and policy,
he has been involved in virtually all legislative and regulatory efforts affecting home care and hospice since 1975,
including the expansion of the Medicare home health benefit in 1980, the formation of the hospice benefit in 1983, the
institution on Medicare PPS for home health in 2000, and the national health care reform legislation in 2010. With
litigation, Dombi was lead counsel in the landmark lawsuit that reformed the Medicare home health services benefit,
challenges to HMO home care cutbacks for high-tech home care patients, lawsuits against Medicaid programs for inadequate
payment rates, along with current lawsuits challenging the Medicare home health face-to-face encounter rule and the
Department of labor changes to the overtime rules under the Fair labor Standards Act.
In addition to litigation, Bill offers extensive community and professional educational services through lectures,
publications, teleconferences, and videos. He is the Editor and lead author of Home Care & Hospice Law: A Handbook for
Executives, the only comprehensive legal treatise on the topic. His lectures include market trends in home care,
compliance, risk management, patient rights, fraud and abuse, health care reimbursement, legislative and regulatory
reforms, and legal issues in telehealth services.

Program Description: In this program the presenters - one is a hospice regulatory expert, one is a hospice billing expert -
review patient billing and clinical qualifications from referral to notice of election (NOE) to certification/recertification to discharge.

Rule will become effective October 1, 2017. In this session, the speakers will talk about Hospice Quality Reporting Program (HQRP),
changes to the hospice wage index and payment rate, aggregate cap amount, new Hospice Consumer Assessment of Healthcare
Providers and Systems (CAHPS®) measures, the launch of Hospice Compare, CASPER reports and the Hospice Evaluation and Assessment Reporting Tool (HEART).
In conjunction, speakers will tie in how clinical behaviors affect each of these changes.

Carolyn Williams has a clinical background in
home health and hospice regulatory and billing compliance. Ms. Williams began her career as a home health registered nurse in
1997 as a field RN. Later, she served as a case manager, Director of Patient Care and served many years’ as a former home health
agency executive. Ms. Williams holds Board Certifications in Healthcare Compliance and Home Care Clinical Specialist - OASIS, and

Jo worked as a hospice field and triage nurse for many years, discovering a big void in exceptional private duty care and nursing services.
Jo opened Acappella in 2006, with a vision to be the leading private pay agency in the DFW area. Jo has won numerous awards for her efforts.
She was selected as one of the “Great 100 RNs” in Dallas in 2007. In 2012, Jo was awarded D Magazine’s prestigious “Excellence in Nursing” for
home care, and was also recognized by Nurses.com magazine as a regional finalist for outstanding home care nursing. Jo served on the Board of
Directors of the Texas Association for Home Care and Hospice, and had an active role on the private pay committee. She is currently serving on
the board for the Community Council of Greater Dallas, and is the committee chair for the Dallas Area Agency on Aging. Jo is an active member of
her church choir, recently performing at Carnegie Hall in NYC. She is originally from New Orleans, where she is in the Krewe of Muses. Jo has an

Program Description: This is a 2-part, rich-media capture of the TAHC&H live training
presentations specifically focused on Texas Chapter 97 Licensing Standards for Home and Community Support Services Agencies (HCSSAs).
It covers topics outlined in the HCSSA Licensure rule related to information on licensing standards and applicable state or Federal Laws, including, required content from
Texas Health and Safety Code, Chapter 250 and Chapter 142 and its intent as it relates to licensing standards that must be met by administrators.
Additional topics addressed include Nurse Aide Registry and Criminal History Checks of Employees and Applicants for Employment in Certain Facilities

Bias, as defined by the American Nurses Credentialing Center’s Commission on Accreditation (ANCC COA/LSNA) is the “tendency or inclination to cause partiality, favoritism, or influence.”

About the Presenter:
Grace Werckle is the Home Care Education Nurse Manager for TAHC&H. Prior to joining the TAHCH staff, Grace worked in the Homecare
Industry for over 25 years. She has had the wonderful opportunity to serve in multiple roles at Home Health Agencies fulfilling positions varying from Administrator/Alternate
Administrator to DON/Supervising Nurse/Clinical Supervisor to Case Management to Field RN. With this, Grace earned extensive experience in Licensed and Certified, Licensed Home
Health and Personal Assistance Services licensure categories. Grace specialized in QA and Documentation including certifications of COS-C for OASIS and HCS-D for Coding Compliance
and has worked under The Joint Commission, CHAP and AHCH accreditations. She received her Bachelor of Science in Nursing degree from Incarnate Word College in San Antonio, Texas and
currently works with Texas Association for Homecare and Hospice in the Home Care Education Nurse Manager role.
About the Presenter:
Jennifer Elder started with TAHC&H in September 2019 as the Home Care Regulatory and Policy Manager and is
now the Director of Regulatory Affairs. Her experience includes Home Health and Hospice Administration, DME Management and Home Care Consulting. Prior to coming to TAHC&H she
worked as a consultant from 2012 – 2017 for home health and hospice agencies and DME agencies throughout Texas. She has hands on experience in the home care industry with the
ADR process, QAPI programs, Marketing and Business Development, Licensing, Accreditation, Plans of Correction and Informal Dispute Resolutions, Human Resources, Policy
Development and Strategic Planning.
