Program Description:The failure to timely report A&E to the Department of Family and Protective Services a
nd to DADS remain one of the higher range license violations among home and community care service agencies in Texas. There are several reasons for this.
First, many times management staff have the misunderstanding that they must make a judgment call as to whether or not an allegation has been made.
Second, middle management staff and delivery staff usually fail to understand how to dignify an allegation estimate.
This presentation examines final orders from the Texas Health and Human Services commission dealing with allegations of
abuse, neglect and exploitation. By examining these cases, as opposed to discussing a hypothetical story, the viewer will gain a better
understanding of what goes wrong when an allegation of abuse, neglect and exploitation is not timely reported to the authorities.
Program Learning Outcome:
Participants will actively engage in the discussion and incorporate best practices for identifying and reporting abuse, neglect, and exploitation into their clinical practice.

§558.260[a][10]marketing
Program Description: Marketing in healthcare is an increasingly complex and dangerous endeavor.
Laws and regulations fail to provide clear guidance as to what the agency can and can’t do as it relates to hiring and training a sales force,
developing sales and promotion campaigns using electronic media, participating on community health fairs, and most importantly, making contact
with the right people, and competing against the big guys! The best ideas in the real-world sales environment often fail to meet the requirements
of the federal and state anti-solicitation laws, safe harbor requirements in the Anti-Kickback Statute, STARK rules, or the Gifts to Beneficiaries
limitations, and competitors are only too happy to report any perceived violations to government investigators who will take it seriously!
This presentation is designed for the administrator who needs to grow the business in a heavily regulated, highly competitive
marketplace while protecting the pocketbook from costly endeavors. Jan will review the regulatory restrictions that impose limitations on the provider,
BUT she will also introduce you to 9 successful marketing strategies that are economical, investigator friendly, and owner appreciated.

Program Description: There are many new business practices taking shape
in the home care/hospice industry. Outsourcing is one business practice used by companies to reduce costs or improve
efficiency by shifting tasks, operations, jobs or processes to an external contracted third party for a significant
period of time. This same process of centralization is utilized by many companies internally to achieve the same outcome.
Home care/hospice agencies must enact smart change management techniques to prepare for this new practice.
Program Learning Outcome:
Participants will actively engage in a discussion on outsourcing and centralizing operations to reduce costs and improve efficiency in home care agencies.

§558.259[d][4]agency responsibilities
§558.260[a][8]skills for working with clients, families, and other professional service providers
Program Description: Transitions in care would seem on the surface
to be a "non-issue" in hospice medicine, but with increasing complexity and segmentation of care for the
seriously ill, patients often enter hospice from the acute care system with unrealistic expectations of
what is needed and what will be provided. Often unnecessary emergency department visits and hospitalizations
result, as well as demands for services not part of the standard hospice plan of care. This program
explores not only addressing the expectations of patients and their families, but also addressing the
increasing expectations of payers. A vision for the future of optimal care of the seriously ill is
presented, acknowledging the daunting steps needed for the evolution of a hospice organization towards
a "full service" model, as our organizations enter into a time of increased demand, regulatory uncertainty,
quality-based scrutiny, and fiscal constraint.
Program Learning Outcome:
Participants will actively engage in the learning activity and indicate an intent to change their practice by incorporating
effective communication strategies and comprehensive care plans to avoid unnecessary transitions of care.
