HCSSA Topic(s) Addressed: §97.259[d][7]abuse, neglect, and exploitation §97.259[d][4]agency responsibilities §97.260[a][6]risk assessment and management Program Description: For the last several years, the failure to timely report allegations of ANE to the appropriate authorities ranks in the top 10 licensure violations for home health and hospice providers. Usually one or both of those is cited along with the failure to timely report. Almost without exception, there are penalties assessed with each failure to timely report. At times, the failure will result in license revocation. More times than not the failure to report is due to agency staff misunderstanding this obligation or misunderstanding what constitutes an allegation of ANE. By examining these common misunderstandings and mistakes you will learn practical steps to avoid them. From the intake of the complaint to the closing of the investigation, this program addresses the processes needed to maintain compliance with Texas regulations. · This program meets continuing education requirements for Administrators and Alternates under Texas HCSSA licensing regulations. HCSSA Topic(s) Addressed: §558.259[d][4]agency responsibilities §558.259[d][7]abuse, neglect, and exploitation §558.260[a][2]development and interpretation of agency policies Program Description:The failure to timely report A&E to the Department of Family and Protective Services a nd to DADS remain one of the higher range license violations among home and community care service agencies in Texas. There are several reasons for this. First, many times management staff have the misunderstanding that they must make a judgment call as to whether or not an allegation has been made. Second, middle management staff and delivery staff usually fail to understand how to dignify an allegation estimate. This presentation examines final orders from the Texas Health and Human Services commission dealing with allegations of abuse, neglect and exploitation. By examining these cases, as opposed to discussing a hypothetical story, the viewer will gain a better understanding of what goes wrong when an allegation of abuse, neglect and exploitation is not timely reported to the authorities. Program Learning Outcome: Participants will actively engage in the discussion and incorporate best practices for identifying and reporting abuse, neglect, and exploitation into their clinical practice. TAHC&H Faculty/Presenter: Troy Brooks, JD About the Presenter:
Troy Brooks a former Assistant General Counsel for the Texas Department of Human Services, the predecessor agency of the Texas Health and Human Services Commission has practiced almost exclusively in the area of non-acute long term care in Texas and throughout the country. This year marks Mr. Brooks 20th year of practicing law. He began as a judicial clerk for the Honorable B. Dexter Ryland, Chief Judge of Louisiana’s 9th Judicial District Court. Mr. Brooks now has his own firm, The Brooks Law Group, which provides a full range of services for healthcare providers throughout Texas and the rest of the country. In the words of Mr. Brooks, “we don’t have the sense to tell a healthcare provider we won’t help them with something. From corporate law, mergers and acquisitions, ADRs, RACS, ZPICs, UPICs and licensure issues, we do it all.” [3137] Abuse, Neglect and Exploitation: The Failure to Report Timely ANE
