overtime, as well as exemptions from those laws, as well as recordkeeping, legal issues for wage deductions, best practices for drafting enforceable wage agreements,
paying employees on time, and minimizing the risk of wage claims. The speaker will also discuss advanced wage and hour law topics, including minimum wage for the
final pay period, how to deal with non-return of company property, the most common pitfalls under the FLSA, and how to handle final pay legally. Finally, the
session will address what to do when an audit or wage claim investigation happens, how to appeal adverse rulings, how wage judgments can be enforced by legal

About the Presenter(s): Kimberly R. Stuart practices appellate law, commercial litigation, and employment and labor law.
As the oldest of her generation in a very large Italian family from Brooklyn (who got to Texas as quickly as she could),
Kimberly learned early that to be heard, you have to get into the action, make your point quickly, and be ready to defend it. Kimberly puts this
experience to use in her practice by dealing with her clients openly and frankly.
Kimberly began her legal career as a briefing attorney to Judge Margaret Garner Mirabal on the Court of Appeals for
the First District of Texas. That experience helped her to identify what it takes to preserve a record at trial and what judges look for in appellate briefing.
Kimberly’s representative employment law experience includes successfully defending employers in FLSA wage actions
and Title VII litigation. She has also effectively represented employees and employers in matters related to covenants not to compete and
fiduciary duties. Additionally, Kimberly has successfully defended her clients, from Fortune 500 companies to sole proprietorships,
in products liability matters including toxic tort defense and appeals. In the area of premises liability, Kimberly won
victories for Fortune 500 companies, such as Walmart and Home Depot, in state and federal appellate courts.
Kimberly knows that the key to a good settlement is strong trial preparation. She prides herself on
building lasting and solid relationships with her clients so she can anticipate their needs
and guide them to the best decision, whether it is to compromise or go the distance.
An important part of Kimberly’s practice is helping her clients avoid litigation altogether through reviewing contracts,
examining trade secret and confidential information protection, conducting self-audits to ensure regulatory compliance, and assisting
clients with best practices training and compliance. In her employment practice outside the courtroom, Kimberly handles all

About the Presenter(s): Grace Werckle has worked in the Homecare Industry for over 27 years. She has had the wonderful opportunity to serve in
multiple roles at Home Health Agencies fulfilling positions varying from Administrator to DON/Clinical Supervisor to Case Management to Field RN. With this, Grace was able to provide focus
and specialty in QAPI, OASIS documentation and training and Regulatory Compliance. She has held both OASIS and Coding certifications in the past years.
Prior to joining TAHCH, Grace served as a contributing member and a Committee chair on several committees including Clinical Practice and Medicare/Medicaid and was honored to receive the
Mary Jo Gabbert Nursing Achievement Award. Grace currently serves on the TCNWS Advisory Committee and serves as the Primary Nurse Planner for TAHCH’s Approved Provider Unit. Grace received

About the Presenter(s): William A. Dombi is the President of the National Association for Home Care & Hospice (NAHC) where he serves also as the Director, Center
for Health Care Law and the Executive Director, Home Care and Hospice Financial Managers Association.
Bill specializes in legal, legislative, and regulatory advocacy on behalf of patients and providers of home health and hospice care.
With over 40 years of experience in health care law and policy, Bill Dombi has been involved in virtually all legislative and regulatory efforts affecting home
care and hospice since 1975, including the expansion of the Medicare home health benefit in 1980, the formation of the hospice benefit in 1983, the development of
Medicare PPS for home health in 2000, and the national health care reform legislation in 2010.
He also has an extensive background in impact oriented litigation. Dombi was lead counsel in the landmark lawsuit that reformed the
Medicare home health services benefit, challenges to HMO home care cutbacks for high-tech home care patients, lawsuits against Medicaid programs for inadequate
payment rates, a nationwide class action against then-HCFA for its failure to enforce the federal HMO Act, litigation directed against the "Interim Payment System"
for the Medicare home health benefit, a lawsuit addressing the so-called Medicare “case mix creep adjustments” in 2008-2010, a challenge to the Medicare face-to-face
physician encounter rule, and litigation challenging changes to federal overtime rules.
Bill is a longstanding and active member of the ABA and American Health Lawyers Association.
About the Presenter(s): Kurt Baumgartel is Executive Vice President of Home-Based Care for Compassus’ care
continuum across Home Health, Home Infusion Palliative and Hospice. He joined Compassus in 2020 at a pivotal period of growth for the company as Compassus and Ascension
became partners in Ascension at Home. Baumgartel has extensive experience leading home health and hospice organizations gained over more than 20 years in leadership in the
health care industry. Previously Baumgartel was chief operating officer of Evolution Health and Ascension at Home. Before that he held executive positions that include
president of Allegheny Health Network’s Home Health and Hospice division, president and chief operating officer of Celtic Healthcare, and president of subsidiary Celtic Living Assistance Services.
Baumgartel is active in several professional associations, has been published in trade periodicals and invited as faculty at professional conferences
on various home health care topics. He completed a fellowship at the University of Pittsburgh Joseph M. Katz Graduate School of business. He holds a master’s degree in
Physical Therapy and a bachelor’s degree in Health Sciences, both from Duquesne University in Pittsburgh, Pennsylvania.

Program Description: Under the Final Rule policies, CMS will assess achievement or improvement of performance based on
designated quality measures and home health providers will compete nationally in their applicable size cohort, smaller-volume providers or larger-volume providers.
Financial Success starts with clinical and operational best practices. In order to ensure that agencies do not incur a negative revenue adjustment, CMS has granted
a one-year pre-implementation phase for Value Based Purchasing. Organizations should use this year to focus on quality value-based performance metrics that will
ensure success under the new revenue adjustment model. Having a quality plan that addresses both outcome and process measures as well as patient satisfaction is
the foundation to success under VBP. This presentation is a must for all areas of home health to include financial managers, clinical staff and operational leaders
