These developments turned the enforcement of the AKB and Stark on its head, often requiring individual waivers in these programs, and failing to accommodate programs that the public programs would encourage. To account for these changes and the dramatic movement away from volume and towards value and alternative payment mechanisms, in December 2020, CMS and OIG published a new set of safe harbors to the AKB and exceptions to Stark.
